Quest Martial Arts Trial Class Terms and Conditions

Age 17 and under must must be accompanied by a parent or their legal guardian on their first visit.

Student understands that under the terms of this agreement, QUEST MARTIAL ARTS L.L.C. obligates itself to furnish Student with competent instruction and suitable facilities for teaching lessons. Qualified personnel trained in the procedures and traditions of the martial arts supervise all class sessions. Official belt recognition and certification will be issued to Student upon the completion of periodic examination. Student understands that he/she will be obligated to pay any required examination fee.

Student hereby represents that he/she is physically fit to take the prescribed course of instruction and that he/she has had an opportunity to observe and participate in the above described art of self-defense prior to the signing of this agreement.

Student recognizes that regular class attendance is important for the student progress and understands that it is the Student’s responsibility to attend the classes. It is further understood that the student is obligated to make payments whether or not the students attends classes. I further understand that failure to complete the lessons does not relieve me of my obligation to pay the tuition in full.

Student recognizes and understands that he/she is obligated to reimburse QUEST MARTIAL ARTS L.L.C. for the cost of any repairs to the studio or equipment contained therein, resulting from the student’s failure to obey the rules and regulations of QUEST MARTIAL ARTS L.L.C.

Student understands that strict observation of the rules and regulations relative to training include the use of protective equipment required by the institute. This equipment will largely eliminate the possibility of accident or injury; however, the institute does not warrant the protective equipment.

Student understands that the course of instruction, employees of QUEST MARTIAL ARTS L.L.C. and/or other students or authorized persons will be engaged in a course of conduct requiring physical contact; and he/she gives full consent to such contact as is required by training.

Student understands and agrees that QUEST MARTIAL ARTS L.L.C. will not be held liable for any injuries, losses or damages caused by or resulting from the acts or omissions of the owners, operators or persons in charge of such establishment or their agents, servants, employees or invitees.

Student releases, waives, discharges and covenants not to sue QUEST MARTIAL ARTS L.L.C. and/or its respective owners, operators or persons in charge of such establishment or their agents, servants or employees (collectively, the “Company”) from any and all liability to each of the undersigned and his or her heirs for any and all claims, demands, losses or damages on account for injury, including death or damage to property, caused or alleged to be caused in whole or in part by the acts or omissions (including negligent acts or omissions) of the Company or of any third party.

Student acknowledges receiving a copy of this agreement.

Being a member of the school, Student will faithfully comply with all the rules and regulations of the school and the traditions of the martial arts. Failure to take the lessons in the allocated time, without written request or approval, invalidates the lessons beyond the expiration date. Student further understands that failure to complete the lessons beyond the expiration date does not relieve Student of his/her obligation to pay the tuition in full. Lessons are not conducted on national holidays, belt-testing dates, and other special event dates.

Student hereby irrevocably grants to QUEST MARTIAL ARTS L.L.C., its licensees, agents, successors and assigns, the right (but not the obligation), in perpetuity throughout the universe and in all media either now or heretofore unknown, to use in any manner QUEST MARTIAL ARTS L.L.C. deems appropriate, including without limitation, in connection with its marketing and advertising, by whatever means exhibited, advertised or exploited, the use of the Student’s likeness, voice, performance, interviews, statements or appearance in such marketing and advertising, still photographs of the Student, recordings of the Student’s voice and the Student’s actual or fictitious name (collectively the “Rights”). The Student hereby agrees not to assert or maintain against QUEST MARTIAL ARTS L.L.C., its licensees, agents, successors and assigns, any claim, action, suit or demand of any kind or nature whatsoever, including but not limited to, those grounded upon invasion of privacy, rights of publicity or other civil rights, or for any other reason in connection with QUEST MARTIAL ARTS L.L.C.’s authorized use of the Rights as herein provided. The Student hereby releases QUEST MARTIAL ARTS L.L.C., its licensees, agents, successors and assigns, and each of them, from and against any and all claims, liabilities, demands, actions, causes of action(s), cost and expenses whatsoever, at law or in equity, known or unknown, anticipated or unanticipated, which the Student had, now has, or may have shall or thereafter have by reason, matter, cause or thing arising out of QUEST MARTIAL ARTS L.L.C.’s use of the Rights as herein provided. The Student hereby releases and forever discharges QUEST MARTIAL ARTS L.L.C., its agents, members, licensees, successors and assigns, from any and all claims, compensations, royalties, liabilities and damages arising out of the Rights granted herein, or the exercise thereof, as provided by the terms of this agreement.

NOTICE OF CONSUMER’S RIGHTS

1. Our health club is formally registered by the state. The registration number is E3833.
2. Our school is not required to carry a performance bond under regulations since we do not collect more than three months tuition in advance and we do not collect initiation fees over $200.
3. You have the right to cancel this contract within three (3) business days after receipt of a copy of this contract. Cancellation must be in writing, and delivered either in person or by certified or registered mail. You are entitled to a full refund.
4. If you become disabled for at least three (3) months during the membership terms and that disability is confirmed in writing by a physician, you have a right to an extension of this contract.
5. If the school is closed for a month or more, you are entitled to your choice of either an extension of the contract or prorated refund, except if the closing is not the fault of the facility, in which case the choice of remedy is the schools.
6. This Notice of Consumer’s Rights is an integral part of the Application and Contract for Membership.
